Terms of use
Last updated: October 15, 2026
Contents
These terms are the agreement between you and {{CONTROLLER_NAME}} ({{CONTROLLER_ADDRESS}}; "Banterhall", "we") for your use of the Banterhall mobile app and the banterhall.com website (the "Service"). By creating an account you confirm that you have read and accept these terms and the Privacy policy.
01The Service
Banterhall is a chat app for groups of friends and communities: halls, text rooms, voice rooms, direct messages (DMs), roles and permissions. The Service is currently free; there are no in-app purchases or subscriptions. If paid features are added later, they will come with separate terms announced in advance; what you use for free today won't become paid without your consent.
02Who may use it
- You must be at least 16. You state this when you sign up, and your statement must be true.
- You may use the Service unless you were permanently removed from it before, or applicable law forbids you to.
03Your account
- You sign in to Banterhall with your Google or Apple account, so your account is as safe as that Google or Apple account. Don't share it. If you think someone used your account, close your other devices in Settings → Sessions and write to us.
- Google and Apple count as separate accounts: always sign in the way you signed up.
- Your username must not impersonate anyone, mislead or offend. A username you give up is held for you for 14 days.
- You may not sell, transfer or rent an account to someone else.
04Rules
When using the Service you agree not to:
1. Share unlawful content or help with anything unlawful. 2. Share any content that sexually exploits children. Zero tolerance: the account is closed for good and reported to the authorities. 3. Share intimate images taken or shared without consent; publish other people's personal details (address, phone number, ID, etc.). 4. Harass, threaten or bully; attack a person or group with hate speech because of race, ethnicity, religion, sex, sexual orientation, disability or similar traits; call for violence; encourage self-harm. 5. Spam, send unwanted bulk messages, defraud, phish, or run fake giveaways. 6. Share malware, viruses, or files and links meant to harm other people's devices. 7. Impersonate another person, the Banterhall team or an organisation. 8. Share content that infringes others' intellectual property (copyright, trademarks). 9. Try to break the Service's security, get into someone else's account, overload our systems, collect data with automated tools (bots, scrapers), or reverse engineer the app to undermine it. If you find a vulnerability, please report it to [email protected]. 10. Come back with a new account to a hall that banned you, or in place of an account we closed. 11. Share adult (18+) content: pornography, explicit sexual content and graphic violence. Banterhall has no 18+ rooms.
05Halls and hall moderators
- Whoever creates a hall is its owner. The owner and the roles they empower can set their hall's rules, time out, kick or ban members, and delete messages. These actions are recorded in the hall's audit log.
- A hall's rules can add to these terms but can't contradict them. We are not responsible for hall moderators' decisions; you can report a moderator who breaks these terms to us.
- Hall owners should make reasonable efforts to keep what is shared in their hall within these terms.
06What you share
- The messages, photos and files you share remain yours; you don't transfer ownership to us.
- So we can run the Service, you give us a worldwide, free, non-transferable right to use your content only to provide the Service (store it, deliver and show it to the people you chose, resize and re-encode photos, create link previews, back it up). This right ends when you delete the content or your account is deleted, except for message texts still shown to other users (Privacy policy section 7) and backups.
- You confirm that you hold the rights needed for what you share, and that it complies with these terms and the law.
- Voice rooms are not recorded. You must not record conversations in a voice room without the other participants' consent.
07Reporting and moderation
- Reporting: you can report a message or a person inside the app (long-press the message → Report message; a person's profile card → Report person). Reports go to the Banterhall team, not to hall moderators; the reported person is never told who reported them.
- Notices of unlawful content: people without an account and rights holders (e.g. a copyright owner) can send notices about content they believe is unlawful to [email protected], with where it is (hall, room or message link), why it is unlawful, and their name and contact details. We review notices without undue delay and tell the sender the outcome.
- Measures: content that breaks the rules can be removed; an account can be warned, suspended for a time (24 hours, 7 days) or indefinitely. A person on our team makes the decision; no account is closed by an automated system alone. When you are warned or suspended, the app tells you, with the reason.
- Appeals: if you disagree with a decision, write to [email protected] with your reasons within 6 months of being told. Someone who didn't make the first decision reviews your appeal, and we tell you the outcome. If you live in the EU you may also turn to a certified out-of-court dispute settlement body under the Digital Services Act (DSA).
- Authorities: orders and requests from courts and public authorities made in due form can be sent to [email protected] (subject: "Official request"). This address is our single point of contact, in Turkish and English.
- We remove unlawful content within the liability framework set by Turkish law (Law No. 5651 included) and EU law; we have no obligation to monitor all content in advance.
08Intellectual property
The Banterhall name, logo, the app's design and software belong to us or are licensed to us. We give you a personal, non-transferable, non-exclusive and revocable right to use the Service for personal, non-commercial purposes in line with these terms. No other right is transferred.
09Availability
We take reasonable care to run the Service well and safely, but we don't guarantee it will be uninterrupted or error-free. It may be interrupted for maintenance, updates or causes outside our control (the internet, hosting providers, force majeure). We may change the Service or end it entirely; if we end it, we give at least 30 days' notice so you can take your data.
10Liability
- Content shared by other users on the Service is the responsibility of whoever shared it.
- To the extent the law allows, we are not liable for indirect damage (including lost profits and lost data) arising from using or being unable to use the Service.
- These limits don't apply to damage caused intentionally or by gross negligence, to harm to life or health, or to the rights you have as a consumer that can't be waived by contract.
11Ending the agreement
- You can end this agreement at any time by deleting your account in the app (Settings → Delete account).
- If you break these terms seriously or repeatedly, we may suspend or close your account; we tell you in advance and with the reason as far as the urgency allows. Where there is unlawfulness, child exploitation or a serious risk to others' safety, we may act without notice.
- Terms that by their nature should survive (rights in content, liability, governing law) continue to apply after the agreement ends.
12Apple and Google
If you downloaded the app from the App Store: these terms are between you and us only. Apple Inc. is not a party to them and is not responsible for the app, its maintenance or support. Any claim about the app (including product liability, legal compliance and intellectual property infringement claims) is addressed to us. As the Service is free, Apple has no refund obligation to you and no other warranty obligation whatsoever. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you are not in a country under a US embargo and not on any US list of prohibited or restricted parties. If you downloaded it from Google Play, the Google Play Terms of Service also apply.
13Governing law and disputes
These terms are governed by the laws of the Republic of Turkey. The courts and enforcement offices of {{CITY}} have jurisdiction. If you are a consumer, your right to apply to the consumer arbitration committee or consumer court where you live, within their monetary limits, is reserved. A consumer living in the EU also keeps the mandatory consumer protection rules of their country and the right to go to its courts.
14Changes
We may change these terms. We tell you about significant changes in the app at least 15 days before they take effect. If you keep using the Service after a change, you accept the new terms; if you don't accept them, you can delete your account.
